Ilex sinuata Chaney & Axelrod (1959: 190 , pl. 38, fig. 4, 11), nom. illeg. non Ilex sinuata Saporta (1865: 190) .

Type:—[fossil leaves] Blue Mountains, Oregon, USA (holotype, UCMP 3170, Museum of Paleontology, University of California, Berkeley, USA).

Occurrence:—Miocene; North America ( USA). Eponymy:— Caeruleomontanus, Lat., from Blue Mountains, locus classicus.

Notes:—The fossil-species Ilex sinuata Chaney & Axelrod is based on the anomalous fossil foliage, which was not evidently related to any extant Ilex species. In contrast, the fossil-species has a resemblance to the leaf fossil-species Mahonia lobodonta Becker , which is re-classified here Alloberberis lobodonta comb. nov. Since the fossil-species Ilex sinuata Chaney & Axelrod is a later illegitimate homonym of the European fossil-species Ilex sinuata Saporta , based on the fossil foliage from the Oligocene sediments of Armissan ( France), a new name is proposed here in the genus Alloberberis .
